Why did Eureka pull out of doing 25-28mm POTA apes, but Monolith/Graven Images/Cliffhanger can do them in 40mm?

Why are we 25-28mm gamers left out of having apes in typical POTA ape costumes?

I just don't get it!

If that is the reason, couldn't Eureka (or someone else) do the same with 25-28mm and get through the same loophole?

Man. I sure do miss Eureka's "Apes With Guns" line. I meant to purchase them at some time, but you know the old saying: "would've, could've, should've".

Anyway, maybe some will turn up on eBay one day…..

So, how did the bastards (whatever those attorneys or hardasses were) find out about it? How did it hurt them in anyway? Where the same anal rentitives trying to put out a similar 25-28mm line of their own?

Can't someone make 25-28mm ones again, under a different name or something?

Well CC, I feel the same way about Eureka's Starfaring Egyptians (the name was some derivation from Stargate). I was waiting for that "right" momement, and waited too long. Now, because of the trouble caused to them, they won't touch anything even close on any movie or TV theme. A sad situation for us harmless gamers, and a real kick in the teeth to a very nice bunch of guys.

Well, given how the system works, sometimes it's prudent to pack it up at the first sign of legal trouble, even if the odds are you're right.

There's a lot of gray area and IP cases are rarely thrown out of court on summary judgement. While you can't copyright an idea like "apes with guns", you can argue about the actual designs etc. in court, and that costs a bundle of money. Easily more than the range would even make in profits, which kinda makes the argueing pointless.

There's two basic strategies in the gray area: "duck and run — I'll make these until I get unwanted attention, legal battles are not worth the hassle" and "stick to your guns — I believe I'm right and I'm ready to defend my position in court". Nic chose the former, and it's his right to do so.

In part, through forums like TMP and the old Stargate gaming Yahoo! group (whose current incarnation has lots of checks on new members).

So if you want figures like these, don't start threads like this one.

It's probably not a matter of CAN and CAN'T, I figure Eureka decided they were too much of a risk to carry, and Monolith disagrees.

I believe there were a few irate posters who came on TMP and started a huge ruckus about these figures and later said they had reported Eureka to the IP owner of the Planet of the Apes stuff. The letter was sent shortly thereafter, I'd imagine.

I can't imagine why they did it…

I was lucky enough to be able to buy 20 "Apes with guns" at Little Wars several years ago. They did not have any mounted so my forces are incomplete. Here's the deal: we as gamers have always been surounded by pirated movies at every Con we have atended. If you have been to Gen-Con or Wizard World you have seen this illeagle product. This is not the same as sculpting your own figures and selling them. We have a "fringe" hobby with a limited appeal. When any company in the future creates "Apes with guns" or shiny one eyed robots, lets as a group just keep it to ourselves. Someone opened their mouth and let the cat out of the bag.

Just a guess, but I'd bet on "destroyed". Eureka was pretty clear at the time that they were going to respect the IP rightsholder's decision. They are VERY careful about IP infringement now.

When you calm down, try seeing the big, 40mm Monolith ones as potential "Tugars" (or whatever they were called in the later Forstchen "Lost Regiment" novels, where the beasts use guns and other more modern equipment):

I'm glad that I got my army of those apes when I did. I created a slave wagon and an artillery piece with limber for them. There standard is a copy of the one used in 'Beneath'. I have around 60 foot and 40 or so Cavalry.

What cavemen are you using?

I have a combination of Foundry Savage Ancient Germans and the Copplestone Cavemen.

I also have some Neaderthal-looking ones that I don't think will pass as post-apocalyptic cavemen.

As far as I know, they still have the molds on a shelf somewhere, but won't/can't cast any more.

I had inquired about the shiny one-eyed robots (AKA Cylon Centurians) and got the same answer…copyrights…put the molds on the shelf…won't cast more…etc.

Not entirely sure about the whole IP thing, but if there are IP issues with replicating the look of ceratin characters, how can the large scale vinyl kit makers get away with doing versions of well-known characters, but released under a different name? Always puzzled me, that one…
