Following their defeat at the Battle of Hawes the Scots, under the Earl of Buccleugh, fell back. Rather than be replaced Buccleugh was reinforced by several new regiments. As a result the Earl deemed himself ready once again to take the field. Meanwhile the Royalist commander, Sir Edward Chisenall, victor of Hawes, had not been ideal. Indeed, he continued to harass the Scots at every turn.

Having caused some discomfort to the Scot line of supply in North Yorkshire Sir Edward deployed his small army near the village of Constable Burton for the expected battle.
