I would rule that he does not have standing and the court does not have jurisdiction.
Then I would have him flogged for wasting the Court's time with silliness.

I find it interesting that neither the article nor the comments discuss what I find to be the most ridiculous part of the suit, the claim that NASA has failed to execute their "statutory duty". What duty would that be? And in which statute?

Has it been ten years now since the lawyer sued the government cause they were keeping secret contact with an alien race. The Justice Dept tried to get it dismissed and tried to make the lawyer look like a crack pot. After he was able to provide evidence that there was more to UFO's than what the government was letting on. The Federal Judge said the case could go to trial. So the government came in with a 13 page document saying the case should be dismissed based on national security. The judge read the document and dismissed the case. She stated what she read in the document was classified so she could not discuss it in detail. But what she read should never be released to the public. The lawyer appealed and was denied based again on national security issues.

So maybe in that 13 page classified report to the judge was information on apollo 18/Mars living rocks that could invade earth?? lol

UPDATE: It was Peter Gersten in 1980, so I'm off by a few years. lol well 33 years is a bit more than a few! lol
