That's it just change the name to StairGate miniatures and its all legal.

I may have a couple of the miniatures in question, I may have been painting them last night to a licensed refence work (yes that little rag that comes with the DVDs).

I think that the producer is safe and here's why.

1. The figures do not resemble the actors, facial details are very different in fact so different it was a bit of an issue as to which to use to represent which. SO no use of the actors image.

2. The figures resemble contemporary US Military in look and feel. As far as I know the US Army does not protect its IP but based on the show I would say they could very well argue that their IP has been stolen. In fact I would swear, if I actually had the figures, that they were lightly converted US Marines.

NB I assume this should hereby be known as the StarGateGate conspiracy theory.

Got this from Mohawky on the Stargate Group regarding the harrasment perpetrator:

"3 people have contacted me today after seeing the TMP thread - 2 UK and 1 US - all of whom I have known for a long time, all have said the same name - and 2 of those people (1 UK and 1 US) have worked with him - he apparently has an IP mania - and is very bitter.
There is a name in the frame. But it will not be published by us without concrete proof. We have two IT experts tracing the email links and talking to the ISP's involved and the hate mail we've also reported directly."

Disney couldn't sue the Sherk or Dreamworks Studios over the use of the fairy tale characters, as the characters looked nothing like the Disney versions. Plus Disney has no legal control over those fairy tale stories IP.

Those Fairy tales have been around for so long their like public domain. If Disney could sue in their behalf then something is wrong with the system as every parent, school, and little children's book publishers could be sued for retelling those tales.

This is why when Disney releases a new movie basied on a fairy tale you see a sudden re-release of older or even foriegn versions of the same story. Disney can't do anything about it.

No, but my point was (and I am guessing) that when they have created, say, Little Red Riding Hood for their movie, the IP rights accrue to that image (not legalise, just trying to make a point). So the little red handbag or slippers with the Disney LRRH on it could not be made by anyone without a licence. Would that make sense?

OK, well this is a little off topic. But this looks like the best place to post it. I was a member of the Stargate Gamers group. In the midst of all this controversy, for some reason I have been banned. Does anyone here have any idea why? If it is a blanket banning of people that were "new" members (I joined in August), is there any word when we can rejoin? I know that there are members on this forum so hopefully someone can help me out. Thanks.

Hmmm well up here in Edmonton we have a big huge shopping mall with rides and a hotel- it used to be called Fantasy Land till Disney sued claiming that this mall up here in all this freaking snow could be confused with Disney's Fantasy Land. They won because of the whole 'mistake us for them' argument. Thats right- they claimed that people would think that this theme park in a whole different country could reasonably be mistaken for DisneyLand. I dunno I still think that some times IP goes a little too far and that people need to get off the greed bandwagon. (for those that do not know the Mall is in Edmonton and Alberta is cold - nothing like Florida or Cali)

On the other hand.... those figures are pretty darn near exzact copies of the TV shows..... and that is not so cool IF the people holding those IP rights wish to enforce them. For example Lucas does care who makes his stuff and who doesnt... but still he doesnt hold the rights to ALL space opera- heck he doesnt even hold the rights to white power armor any more than GW does. So Stormtroopers are a no-no but thats it.

I think the thing that is the real problem here is that any possible infringement of an IP should be reported to the holder and THEY can decide what they want to do- not some raving 'fan'. What this fellow has done is turn it into his own little hate war where he imagines himself defending all that is good and right etc etc... when in fact his actions will likely make people from both sides lose in the end.
