The 44th Regiment of Foot was formed in 1741 by Colonel James Long a former officer of the 1st (Grenadier) Guards as James Long's Regiment and later John Lee, when it became known as "Lee's Regiment, or 55th Foot, only gaining a confirmed numerical designation during the Army restructuring of 1751 when it was renumbered the 44th Foot.

During the American War of Independence the saw action at the Battle of Brooklyn in August 1776, the Battle of Brandywine in September 1777 and the Battle of Germantown in October 1777[12] as well as the Battle of Monmouth in June 1778. In addition to these major battles, the 44th was involved in several smaller actions such as the Paoli Massacre in 1777, the Danbury Raid, 1777 and the Battle of Horse in 1779. In May 1780 the regiment moved to Canada, where it saw out the war in garrison until returning home in 1786.
