So I got two official notices from, I think, the lawyers for Robot Peanut and the Bakers. I got scared a minute since I didn't expect to get a bankruptcy notice personally. But it wasn't about me, but I didn't recognize the names till the one for Robot Peanut showed up in the mail today. Really unclear what they were about, or that I personally was relevant. Was surprised they include things like people social security numbers and such. Or what I could do now that I got them. Frankly I got pretty much all I ordered in wave I and II and am sad they couldn't finish. I don't have to do anything with these notices do I? |

Receiving SSN's is a serious breach of confidentiality and represents highly unethical behavior from the legal firm, if that was the source of your emails. They have opened themselves to what could be serious liabilities, especially if reputational or financial harm results from their carelessness. |

OP seems clear to me, too. Legal actions can be quite mysterious at times, and odd if personal data that could be used for identity theft was included. |

Never heard of Robot Peanut either. Though I've hear of Architects of War, AoW is an obscure brand. As for the legal notices, read them carefully two or three times. Then save them. And if your SSN is included in the mailing, there is probably additional actions you may need to take. |

If you received one then you probably would know what they were talking about and could help the OP by answering his question. |

I've gotten two, though my order was fulfilled. I'm guessing that they were sent to all customers after a certain date. And there is no money to pay creditors according to the notice. |

Its the SSN and EIN of the debtors, IE robot Peanut Studios which is part of the bankruptcy information. One is for the company bankruptcy, and the other is for the owners personal bankruptcy as it relates to the business. No personal info shenanigans, just regular legal paperwork. |

They ripped me off for around $20 USD so I will just live with it. Gave me a jolt seeing them in the mail and until I saw "Robot Peanut Studio" I did not have a clue. |

These are notices that are part of the Chapter 7 bankruptcy filing and are being sent to all identified creditors. I've received several so I'm not sure if they lawyers just decided to send these out to all customers just to be safe. The purpose of the document is to allow a creditor to file that their debt should not be discharged and the reasons why. All creditors have until May 17th to file for the waiver of discharge. From what I understand, the secured creditors have gobbled up any assets and there really isn't anything left for the unsecured As others have stated the SSN's listed are those of the business owners (which are required by law) and no customer personal information is disclosed. The formal Bankruptcy hearing is scheduled for March 18th in Westmorland PA and and creditor is allowed to attend although I have no idea why you'd want to see the proceedings. |

Yes, those had my wife pretty worried. Once I saw Robot Peanut on the papers, I knew what was going on. But not quite sure why I got it. I ordered some terrain during their 35% off Christmas sale. I got everything I ordered, then literally the next day I started seeing the buzz on TMP about AOW and Robot Peanut disappearing. Too bad really. I really liked their stuff. I guess I should have bought more of the AQMF figures, but I couldn't find anyone else willing to play it with me… |

Just got two notices – I'm in the UK and only subscribed via the kickstarter. So it must be a default action by the court. If I hadn't read this thread before I might have been worried on receiving stuff from a US court. I wondered why I got two letters, then read them properly, one is for Ernie Baker personally, and the other is for Robot peanut Studios. AFAIK I got everything promised, and am not about to hop on a transatlantic flight over a few figures. Shame, as the product was good. |

No letter yet; I never got my wave III stuff from the KS but I don't think anybody did. I'm no lawyer, but thought Robot Peanut as an LLC offered some form of asset protection? Why would the Bakers have to declare personal bankruptcy? |

I just received the same set of letters. Yep, must be a default action by the court to all customers with outstanding unfulfilled orders or customers who put in claims with Paypal or their credit card companies I suppose. I put in my claim with Paypal about a month and a half ago, and Paypal was able to recover my $65 USD pretty quickly. But Paypal handles these kinds of disputes by essentially charging the vendor's account for the amount question. You as the customer get your actual funds back, and in this case Robot Peanut gets a charge placed against their account, sort of like putting an account into a kind of overdraft. |

I don't know anything about the finances of the Bakers or AOW/Robot Peanut. However, generally speaking from my experience as a paralegal, if the Bakers personally guaranteed any of the debts of Robot Peanut, they would still be responsible to the creditors of the company for those debts. In those personal guarantees could have been a mortgage(es) against any real estate the Bakers owned, notes against retirement and/or other bank accounts, and any other tangible personal assets. When the bankruptcy was declared, I am sure that the customer lists were turned over to the bankruptcy attorney representing the Bakers their companies. The attorney would have either generated the notices everyone is receiving or the Bankruptcy Trustee did. If you bought from Robot Peanut or AOW and your order was fulfilled, these are just pieces of paper. On the other hand, if you purchased from Robot Peanut or AOW and were charged and did not receive your order, you need to consult an attorney as to what your next steps might be. Also, if you owed money to Robot Peanut or AOW, you should also consult an attorney so you don't get mired in legal action brought by the Trustee to recover assets that can be used to pay creditors. Again, I am not an attorney but a paralegal. I am not familiar with the specifics regarding the Bakers and Robot Peanut. I am speaking from my experience as a paralegal and my familiarity with the bankruptcy proceedings as I did them for my boss many moons ago. Nothing said here should be construed as legal advice. And yes, The Warstore got those notices as well. |

Hmm. Searching suggests that if it's the reverse (someone personally goes bankrupt), it can affect their LLC (since it's still an asset). Also, if you mismanage your LLC by, say, using an LLC account for personal use, you can lose your LLC protection. |
