Did he? I know Abba always said that…."Napoleon did surrender" (at Waterloo!)……and the legal distinction is very nice one. But he is no longer a head of state having abdicated, he no longer holds any military rank, as he has been refused a generalship by the Assembly, I gather. He "sought the protection of……….". In modern parlance, he was an asylum seeker. Now, he has family (if not dependents) abroad, in Austria, so he may be entitled to UK benefits, which he could send back………..there is Habeas Corpus………no, I'll stop this neo-fascist ranting now!

The British Government wisely refused to let Bonaparte land – precisely to avoid some of these issues, as IIRC a Radical MP was proposing to issue a writ of Habeas Corpus…
