Add him to your blocked sellers list and don't stress about it. eBay won't care as long as they get their cut.

napthyme28 Jul 2014 3:29 p.m. PST

He's a top rated seller with no negs and not nuetrals, there not going to say anything to him.

Better to just move on and forget it.

Privateer4hire28 Jul 2014 3:32 p.m. PST

Does Foundry make these any more?
Guessing it's Street Violence range and I'm not seeing it on their site (maybe overlooking?)

FABET0128 Jul 2014 3:36 p.m. PST

I agree, it is annoying but using the word rare when has just become part of the shoeshine of selling there (sort of like new and improved).

To bad you don't have to pay $5.00 USD to use the word "Rare" in your description. $50.00 USD for using "Unique".

GonerGonerGoner28 Jul 2014 3:51 p.m. PST

Is it a recast? Ebay will shut down recasters as fast as a rat through a drainpipe. Try checking with Foundry.

Ebay won't do anything about the title or the price unless their trained monkeys can spot the problem and unless the monkey is a gamer they won't know the distinctions.

chriskrum28 Jul 2014 3:59 p.m. PST

Looks like you're trying to escalate a personal pet peeve into something that's actionable.

"Rare" doesn't have an actual concrete meaning.

It's the responsibility of an Ebay shopper to do their own research, just because it's overpriced on Ebay and available somewhere else for less doesn't mean people shouldn't be allowed to list it and others buy it for that price.

It appears he is actually selling what he claims and then delivering on each sale. You have the issue, not him. Do what the other poster suggested, block him and get on with your life.

The same thing was happening with some of those Atlas Editions 1/1250 scale warships. The seller was saying they were rare when in reality the production lines in China were chucking them out as fast as their little cogs could turn!

I contacted the seller and politely tried to explain he was in error when posting these things as rare. I got a nasty one sentence response telling me to mind my own business.

What did I do? I minded my own business.

Complaining about "rare" is like complaining about "pro-painted".

Just let it go JJ. Not worth getting worked up over.

Caveat Emptor……………

Sobieski28 Jul 2014 7:22 p.m. PST

Be careful when buying works of art too. The antique section is full of cheapo reproductions.

Wachaza,
My experience with ebay and recasters in China, is that they don't want to know, and won't do anything about it.
Could you e-mail me at nicr@eurekamin.com.au and tell me your experience? I would love to I know how to get re-casting stopped.
Looking forward to hearing from you,
Nic Eureka Miniatures

Scanning his feedback, he has a lot of overpriced (to me) items that people like to buy. He can also say it is rare because it is being offered as a single figure.

Privateer4hire28 Jul 2014 9:04 p.m. PST

To Nic: Would think any efforts to be successful you'd want to send something via paper copy preferably on your company letter head or from your solicitor.

combatpainter Fezian28 Jul 2014 9:26 p.m. PST

They don't care.

haywire29 Jul 2014 5:25 a.m. PST

rare, oop (out of print), and "professionally painted" are all phrases on ebay I do not believe without the proper research.

'caveat emptor'…..

RavenscraftCybernetics29 Jul 2014 7:23 a.m. PST

considering the actual numbers involved in manofacturing our hobby, everything is rare.

War Panda29 Jul 2014 8:57 a.m. PST

My mam used the word as great…rare olde time last night!

We know that's not what he means but ….

Dynaman878929 Jul 2014 9:49 a.m. PST

Perhaps rare means it has not been cooked all the way through?

We live in a world where massed produced brik a brak is considered "collectable" (beanie babies, etc…) so I can't see getting worked up over this.

Nic Robson29 Jul 2014 7:52 p.m. PST

To Privateeer4hire,
Paperwork sent, registered, forms filled on line, e-mails sent. Each e-mail answered by a different person, all of a sudden no more e-mail replies.
Telephone calls answered and told to send paperwork, which I did and it has never been answered.
I am really hoping that Wachazza will get in touch with his experience.
There may be something I am doing wrong.

I just treat it like fraud, and the seller as untrustworthy. No point in trying to do something about it.

What happened to our society that we now treat little frauds as if we have no right to complain about them?

AussieAndy04 Aug 2014 8:18 p.m. PST

One unfortunate thing about a seller describing something as "rare" when it obviously isn't, is that the people who are most likely to be duped are non – gaming folk seeking to buy presents for their friends or relatives.

Nic, it won't be of any comfort, but the Chinese will eventually start to enforce intellectual property laws when they have their own intllectual property that they wish to protect. That has pretty much been the way with all developing nations. The worst infringers of the 19th century were, of course, the Americans. Charles Dickens was driven to dispair by American pirated editions of his books.
In the meantime, you need to talk to an intllectual property lawyer.
