Out of copyright means just that, so yes. However, you have to use the original – if you use an out of copyright map from a modern reproduction, then the modern reproduction is copyrighted to the author of that reproduction. |

What are you doing with your own work? Is it free to give away or are you going to sell? Copying any map (in copyright or not) probably constitutes "fair use" but if it is a commercial product, only the material out of copyright could be used. The other could only be used with express permission from the owner. |

Imagine I wrote a scenario for Talavera and wanted to publish it: could I use an image from Oman's History of the Peninsular War from one of the online 'copyright expired' versions? Regards |
