Just wanted to let people know that New Wave refunded me for miniatures owed from 3 years ago. I was surprised one morning to get a phone call from them saying they found an invoice behind a desk, and saying that they wanted to take care of it. After talking to both Mrs. Doust on the phone and to David Doust through email I recieved a credit to a credit card, a miniature owed sent (I didnt even know I was owed this one) and another refund via paypal. I want people to know they called me out of blue on their own iniative as I had written it up as a loss over a year ago and hadnt contacted them in ages. They were helpful and wanted to make it right. Hopefully for others owed this will happen to you as well. I am posting this because I had in the past posted that they owed me in a response, so feel I need to let people know at least I am taken care of. |

BTW they categorically refused to refund my money with an 8 month delayed order. I had to use credit only and I made a long list nad they eventually substituted for things in stock. Color me skeptical. |

They refuse to send me a refund- according to them, they claim they sent out my stuff, but since it never returned to them, they 'assumed' I either had recieved it, or it was 'lost' in the mail... Right now, I've got enough attorneys going up New Wave's backside, they'll think they opened up a branch in there... |

What I don't get is that with all those people being upset, threatening lawsuits etc, how can they still be in business ? How far can you go before a guy with a badge steps inside and starts to read your rights ??? |

There isn't a lot that people can do to New Wave, sans not buying from them, as long as the dollar amount is not too great. I'm not defending bad practices, but I always laugh at people who cry "lawsuit" and then really don't follow up on it at all.

Plus the idea that a guy with a badge will step in to investigate is laughable. Local police will chalk it off as a bad business deal/civil matter. State police will referr you to the better business or Attorney Generals office. If your lucky to get your states Attorney General involve. All they do is send them one threatening letter. Then send you a letter every month telling you to reply or the case will be closed. So low and behold you either forget it or take it to small claims court. Anyone who says they have an attorney working on something that has a value less than $10,000. Then either you have more money than brains or the attorney is milking you. Thats why they have small claims court to settle disputes with out spending a fortune in attorny fees. By the way I went through all the above. Three days before the statue of limitations was up I filed in small claims court. The gentleman settled out of court the day we were suppose to appear before the judge. :-) |

P.S. Be careful when you go to court. Some judges feel the ignorant masses are not smart enough to present a case to them. When you represent yourself in court they get ticked cause you did not pay a lawyer to speak for you. They will nit pick and toss out every thing you file. One such judge did this to me. So I went to the area he use to work as a lawyer before becoming a judge. Found some of his old cases he filed. Copied his for mine and changed the names, dates and such for my specific case. When he kicked it back for not being done properly and advised me to have an attorney draw up the papers. I then explained to him I did and where I got the information. Then the local paper did an article on it. The reporter put the Chief Judge in the hot seat for allowing this Judge to get away with this even after several complaints. So you can get around it but remember the court house is their house and your an unwelcomed guest. |

Hey, I bet they're trying to rehabilitate their reputation. Between their bad rep, the GW mailorder crackdown, increasing competition (and great buzz on their competition) it's either that or give it up. I'd prefer that they hand out all those refunds and then go belly-up, natch. :) |

Basically, all I did was filed complaints with my states AG office, the GA AG office, the FTC (Mail Order Action Line) and a private attorney (which is already covered). Some of you here may think it's a lot of "bunk" and "laughable", but at least I'm making an effort to get my money back (and a lot of money at that). Who knows what will happen; I may get my refund, I might not. It's not costing me anything. If New Wave ends up on the chopping block for fraud, all the better. |

After several months of dead-ends, and having false accusations leveled against me by New Wave (they attempted to accuse me of 'threatening' them by adding a post from another poster on TMP, as an 'attachment' to some things they faxed to the Ohio AG's office- thanks to the Editor's assistance, we were able to clear that up), things finally worked out. Well folks, on 04 Feb 2005, I recieved a full refund for $172.60 USD from New Wave Mail Order. For those of you who are still looking for a refund, or have yet to file a complaint, contact- The contact information has been removed, since "...our office has concluded it's investigation of the company and will no longer be able to accept further complaints based on the fact that we are in litigation and or taking civil penalty action against same." |

Ahem - The Red Sox are indeed the current champs, just in case you missed it.... New Wave owes me about $ 25.00 some odd in miniatures from about 3-4 years ago, after I very, very slowly and painfully 'recovered' and substituted for another about $ 80.00 something. Perhaps my invoice is under the microwave.....? |

Delljohnb- I like Jethro Tull, but I actually got the name from the 'Gaunts Ghosts' novels written by Dan Abnett (based on Games Workshop's Warhammer 40K universe); the character is Commisar-Colonel Ibrahm Gaunt's aide- the name had a certain ring to it :) As for my situation with NW, I'm just happy I got my money refunded after all the headaches and dead-ends I went through. |

I was contacted by the investigator last Thursday and was asked to post this. The State of Georgia has concluded it's investigation against the company, and is in the litigation process and taking civil action. The office is no longer taking complaints at this time, until the current action is settled. It seems that quite a few of you have contacted the investigators office; they have more then enough information, and basically they need to continue, unimpeded. What does this mean? PLEASE DON'T call the investigators office anymore. Let them do their job =) |

Another TMPer brought up a good point on another thread. You folks don't know me from Adam, and I don't blame anyone for disregarding my last post. You have every right to seek justice and rightful compensation. I cannot stop any of you from contacting the investigator, nor prevent anyone from taking that contact information (which had been posted since early-mid February of this year- roughly six months) and copying it elsewhere on the Internet. |
