So I want to try out Legends of the old west or Gutshot and I want to collect an outlaw gang of ex-confederate diehards and was wondering what figures I should use.

I'd go ahead a use ACW Confederates, symbiont. Concentrate on those that are dressed more like civilians, but toss in those that look to have an incomplete uniform. And don't be shy about using figures that are in the old greys, as you said that they're "diehards". Check out manufacturers such as Dixon, Redoubt Enterprises, Essex, and Wargames Foundry. They make ACW ranges so extensive that I'm sure you'll surely find what you need.

Sounds cool. I have wanted to do something along those lines. 00 Jet 00 or one of the Geektactica bunch has a gang of Confederate diehards. You might want to ask him who makes them. I also know wargames Foundry makes some good Confederate irregulars (Quantrill's Raiders) as well as the James Gang. Also check out Reaper's Josey Wales, be warned though he won't fit as well with other ranges.

Dixon are a good choice because you can pick and choose individual figures… but there's a baffling list to choose from, and many aren't pictured on the site. So unless you know what a Havelock hat, shell jacket and prussian pack look like, it's a bit confusing.

I'd go with Redoubt's dismounted cavalry figures… lovely sculpts at £1.00 GBP per figure, seperate heads, so you get to choose their headgear.

I have used various figs from my ACW Confederate units, with more butternut than grey and only a few forage caps – the Foundry Vigilantees and Murderous Militia work well

Foundry has a one legged veteran in kepi in pack OW 9/2, The Good, the Bad and the Ugly. I thought they also had a former Confederate officer in one of the Old West packs (a friend had this figure, back when Foundry sold individual figures), but I can't find him this morning. Maybe I need to eat.

Old Glory and Dixon should have what you're looking for. To spice things up a bit, I suggest putting one or two of the outlaws in only civilian clothes (maybe even of brighter colors). That will really emphasize the haphazard look of your gang.
