The following is a formal and public notice that I require The Miniatures Page to remove material that they have taken from my without my permission and used on their web page, TMP link Some of the material taken and used without permission is copyrighted and all of it is my intellectual property. This action is certainly unethical and probably is also illegal.

I wish to have no connection, or to endorse in any way, this disreputable web site or its unethical or illegal activities. Therefore I would prefer if there was no evidence of all of my presence and the presence of the material taken from me and used, possibly illegally, on this site. So if possible I would wish for the complete removal of the material in question, the message headers containing my username and any other indication that I was on this site.

I recognize that this may not be possible for technical reasons. Therefore it is also acceptable if you replace, cut, all the material with ‘SNIP' markers as you already do and leave such evidence as can not be removed, for example the message header with my username. If you do this I require that you place at the top of the message this statement:-

"This message has been removed at the request of the author who no longer wishes to have any connection with this site"

After this will be the ‘SNIP' icon.

You also have my permission to do this for the messages sent by me via this account and others I may use from this time on.

Your website has been infringing my copyrights and intellectual property rights for more than 2 years now and in 5 separate incidents. Therefore I require that you act now as a priority. If they are not removed within a few days I will consider taking further action.

If you remove my copyrighted and intellectual property from your site I retain the right to seek redress for your actions. I will not exercise this right unless you continue in the future to take my intellectual property and copyrighted material and use it without my permission. It is my intention that this will deter you from once again taking my material without my permission and using it in contravention of my intellectual property rights and copyrights.

??? I really hope this is just a poor attempt at a joke.

Jeff

Orbit196622 Jan 2008 4:38 a.m. PST

Oh and I forgot. As TMP will probably ban this account and delete/edit the above message, as with the others. Can some one copy it and re-post it. I am traveling at the moment so no time to deal with despots :)

Please use a new or unused account to do this as you may get banned.

Thanks

Doc Perverticus22 Jan 2008 4:40 a.m. PST

I just did an Author-search on hwicccee- found nothing
Also did a Google search on hwicccee- found nothing
I found a hwicci though-

this whole thread is a poorly conceived trolling attempt

Pygmalion22 Jan 2008 4:42 a.m. PST

!?!
I hope this isn't going to be like the Minden Miniatures fiasco all over again!

BillChuck22 Jan 2008 4:43 a.m. PST

Specific links and information about your supposedly infringing material are much more likely to get you the response you are looking for. Vague accusations and demands won't do more than get us to laugh at you.

Doc Perverticus22 Jan 2008 4:46 a.m. PST

orbit1966- account created today-
futher proof of trolling

Sorry trying to do many things at once.

See "Recent Departures: Hwiccee" thread on Talk about TMP board.

'I say we nuke it from orbit…only way to be sure….'

C'mon Dr AP, you should have said it FIRST!!!! 8-)

or can we just send it down the KNUCKERHOLE!!!???

*slish…slish*

Orbit196622 Jan 2008 4:51 a.m. PST

Whoops I also forgot to say that the Editor knows the details, URL's, etc. This is just a formal notice that he can not deny that he has seen. I have told him all about this off forum for more than 2 years.

mad mac22 Jan 2008 4:52 a.m. PST

Sorry – this is all becoming a little too pathetic for me.

Hard lines on anyone who happens to shar we a similar IP range to our 'culprits', but it looks like there isn't much you can do other than bar the range.

There's always someone who wants to spoil things.

Now this is a good one to frame and hang on the wall, to have a good laugh once and again when it catches my eye.

dampfpanzerwagon Fezian22 Jan 2008 4:59 a.m. PST

I've not read and re-read the initial post and still have no idea what it is about!

I do know that TMP is a mouthpiece for the industry (and by default my mouthpiece) so I am offended, but I don't know why!

Thank goodness for the stifle button!

Doc Perverticus22 Jan 2008 5:02 a.m. PST

First post listed an ex-TMPer named 'hwicccee' ( note the 3 Cs ) – that's the name i author searched on

further posts spelled hwiccee with 2 Cs which turns out to be legitimate

I withdraw my trolling accusations

Alxbates22 Jan 2008 5:05 a.m. PST

???

Really?

Griefbringer22 Jan 2008 5:05 a.m. PST

I would also like to see:

- Links to the articles that supposedly infringe the copyrights of the said poster.
- Some information on where this material was originally published before being placed on TMP.

DontFearDareaper Fezian22 Jan 2008 5:05 a.m. PST

All rather vague and foolish to me.

Yup … Don't know exactly what the fuss is about (came in to late to see the posts the fellow was upset about.

Shouldn't formal notices look a bit more formal and be delivered in a more formal manner rather than a forum post? I'd expect at least a real name, since an anonymous handle is..anonymous. I don't think anonymous legal notices make sense.

On another note, I don't think someone can send in an editorial to a newspaper and after it's been printed ask the newspaper to destroy all the copies because they don't agree with the newspapers policy. Use logic.

combatpainter Fezian22 Jan 2008 5:25 a.m. PST

Lol…The effects of a full moon perhaps? Is it full? You are full of your self. I really don't see too much "intellectual" anything on TMP let alone anyone's property.

Please put down the pipe and get some help. Lol…Just kidding.

Your right…

red dreads22 Jan 2008 5:27 a.m. PST

<childish snigger> You're funny,…..not humerous,….. but you are funny.

TheMackster Fezian22 Jan 2008 5:31 a.m. PST

I thought the post should have turned to stone like most Trolls do when exposed to daylight.

Some people are just pathertic beyond words.

streetline22 Jan 2008 5:45 a.m. PST

So…. you posted the material??? Post some links to this material, please…

GarrisonMiniatures22 Jan 2008 6:06 a.m. PST

So …. is this someone who feels that reviews are a breach of his rights? or that you can't link to his pages or something? This posting seems to come under the heading 'Ooo look, I've got a gun, there's my foot' BANG.

Supreme Dalek22 Jan 2008 6:08 a.m. PST

Unless Mr hwiccee has about a grand to talk to a lawyer, it seems a pointless post to me…

Pygmalion22 Jan 2008 6:13 a.m. PST

Possibly not a good idea to name and shame someone Gungnir, you could get caught up in legal trouble if he gets harassing emails.

Personal logo Gungnir Supporting Member of TMP22 Jan 2008 6:16 a.m. PST

Just something that is open on the Internet, a ten second Google search, Postumus. I would agree if it was information only I had. I'd love to see a Dutch court call me in for using Google.

And I'm not shaming, I just want to show who we are talking about.

WarmasterCharlie22 Jan 2008 6:16 a.m. PST

yee-haw!!! Here comes another train wreck! Honey, get my popcorn!

Skeptic22 Jan 2008 6:24 a.m. PST

What IP is it referring to? Its posts on TMP?

Pygmalion22 Jan 2008 6:29 a.m. PST

Well I must admit I did google him myself to try and find out which pages of the Necronomicon were stolen from him by Bill, but the cult seem to have removed all traces of the arcane "material".

wminsing22 Jan 2008 6:33 a.m. PST

I'm fairly confident that posts made in a public forum (such as this one) cannot be copyrighted or otherwised protected.

In fact, I would *not* remove the posts, so there's a 'paper trail' in case this gets escalated later…

If you have sent me any URLs, I have not seen them.

This is just a formal notice that he can not deny that he has seen. I have told him all about this off forum for more than 2 years.

Sorry, but I have no recollection of any discussion with you about this matter prior to this week.

DontFearDareaper Fezian22 Jan 2008 6:59 a.m. PST

OK, who do I talk to about getting a piece of the popcorn concession on this silly series of threads?? grin

Dave

combatpainter Fezian22 Jan 2008 7:01 a.m. PST

I know I'm stupid but…Does he mean that when you post and you goggle a topic your post comes up with the link to TMP?

This must be what he means. So if I do a painting tutorial and someone googles painting tutorials you get a link to TMP and my tutorial. This is his copyright infringement claim I think.

Any thoughts?

Personal logo Editor in Chief Bill The Editor of TMP Fezian22 Jan 2008 7:04 a.m. PST

He's talking about "5 separate incidents" over two years, so it must be something other than just his posts. But I have no details from him.

Pygmalion22 Jan 2008 7:05 a.m. PST

But then his beef would be with google not TMP wouldn't it?

Tgerritsen Supporting Member of TMP22 Jan 2008 7:07 a.m. PST

I suspect this guy doesn't know the definition of fair use. And, uh, free promotion is somehow illegal? How does Bill make money off promoting this stuff for free? (Not that this would EVER go to trial, but it would be humorous to watch as a fly on the wall).

Oh, and, if you are going to make a formal proclamation to anyone, you should probably proofread it before posting, though as mentioned earlier by someone else, a forum post is hardly a legal notification.

Pygmalion22 Jan 2008 7:08 a.m. PST

Maybe he should post his material here.
It would of course invalidate his argument about other people posting it here but we'd atleast have some idea what he was talking about ;-)

pavelft22 Jan 2008 7:23 a.m. PST

Sounds like someone is just angry from zipping his twig and berries into his trousers.

Photonred22 Jan 2008 7:31 a.m. PST

First you have to have a set to do that pavelft sadly I doubt the OP does

Brent2751122 Jan 2008 7:33 a.m. PST

What is he talking about? What are the specific infringements he wants addressed? Is orbit1966 a real member?

Brent

John the OFM22 Jan 2008 7:40 a.m. PST

His claim is moot. If you look at the upper left of EVERY page on TMP, there is a note:

©1994-2008 Bill Armintrout

If he posts to a page that has this notice on it, he gives up any claim he "might" have.

Caesar22 Jan 2008 7:41 a.m. PST

Maybe the guy might be trying to create controversy to get his name out there for free advertising.

John the OFM22 Jan 2008 7:41 a.m. PST

all of it is my intellectual property. This action is certainly unethical and probably is also illegal.

I see that he is really sure of his legal standing, too.

Personal logo McKinstry Supporting Member of TMP Fezian22 Jan 2008 7:44 a.m. PST

Personal posts on a public forum such as TMP are about as protected as letters to the editor in the New York Times. That would of course be zilch.

Personal logo Dan Cyr Supporting Member of TMP22 Jan 2008 8:09 a.m. PST

The guy got angry on the 18th century board, got dog housed, got even more upset, created lots of new profiles in attempts to post and finally got banned.

Now he's claiming to be someone else (most likely) and still being silly.

Posting on a "free" site gives you zip for intellectual rights, and unless you have permission ahead of time and claim IP/TM at the time, nothing.

This guy either does not understand what he's talking about (most likely), or is still trying to annoy folks (including Bill).

Since he is located in a country other than the US where Bill is located, I'd love to see what he'd have to spend to even start a legal attempt (that would fail).

Back to reality now. Let's move on.

Dan
