Online gaming. Yeah, I know. Not miniatures. But most online games suffer from hackers. Servers are commonly rented by someone to provide a gaming venue for the public. There is usually no charge to play a game in them.

So the question is, can you sue a hacker or at least obtain a court order against him, who is attempting to "kill" the server by hacking in it, his stated goal to make it so bad no one will play?

It depends on where the server, the owner of the server, the person who rented it and the hacker are.

If any of these (preferably the hacker) are in a country where there is a law against it you can do something. I know that here in Germany it is a criminal offense. But I guess in most civilisted countries you could a east get a court order against that person since he is tempering with something that belongs to you even if it is just your right to use it as you please.

Cheers,

Burkhard

And assuming you can prove who was using the computer at the time of the hack.
