As mildbill says, titles cannot be copyrighted. That's true in the UK as well as the US. Once can create a Trade Mark, such as Buck Surdu has done with his WWII rules, but one could not do that with a well known saying or phrase. "Through the Mud etc is taken from the motto of the Royal Tank Regiment so that would not be possible, rather like Kiss Me Hardy or similar well known sayings.

It is a real shame that despite my contacting the author/publisher of this work their attitude was a shrug and a don't care. We had a very similar issue some years ago when our Dark Age rule set was going to be called Dux Bellorum. We were contacted by Dan Mersey who was developing a set of rules with precisely the same name for Osprey. We immediately deferred to them as their artwork was already complete and went with Dux Britanniarum.

It seems painfully obvious to me that to duplicate the title of another rule set can only lead to confusion. However, there is nothing that can be done. Its a difficult area and I devoted a whole chapter to it in my autobiography, "My Struggle".
