It's never been listed in their rather… ahem, "robust" list, so I'd take that as a strong indicator, as I would the fact that they haven't filed sued against directly competing studios (Daiei- owners of Gamera and Daimajina- and the Tokyo Broadcasting System/Tsuburaya Productions- co-owners of the Ultraman properties- in particular) is also pretty indicative, precisely because of their aforementioned extreme willingness to file said orders.

In addition, I'm not sure kaiju really could be copyrighted- Marvel only managed to acquire copyright status on "mutant" in relation to an incredibly narrow band of the potential interpretation (i.e., those granted superheroic powers by virtue of natural or induced mutation)- they have no grounds to protest the use of the word outside of the superhero genre.

Kaiju, on the other hand, simply are what they are. There is no "Toho interpretation," as such, even so far as the whole "reptilian/saurian monster" aspect, since dragons. ki-rin, and other such figures were kaiju long before the notion of copyright (or, indeed, film) existed- it's not a specific interpretation, so much as the over-arching classification.

So, yeah- they're safe.
