Marianne is always depicted this way. It's a very conventional pose well executed.

The 1789 figure have other dress… maybe this is an adaptation for 1830 (?)

Marianne if from the 1830 period; the tricorne much earlier.

Given that Marianne was always a symbolic figure rather than an actual one, it may be that this is Marianne "as depicted" in 1830 rather than representing typical 1830s dress. The Marianne of the 1790s (she first became widespread after the 1792 revolution, rather than the 1789 one) often wore a phrygian cap, which was obviously long out of fashion by that point.

By the 1830s it might be that Marianne was sometimes depicted wearing a tricorne to hark back to the First Republic and the revolutionary spirit.

However, that it's titled "1830" is presumably to refer however to the famous Delacroix painting of that year. This Marianne is dressed differently to that one: Delacroix's has a phrygian cap and a rifle, rather than a pistol: she also has both breasts bared and no bandolier (a rare case of a miniature being more restrained by comparison?!). The phrygian cap seems to be the usual standard for Marianne throughout her "life".
