Who owns the rights to the name of that creature? Or is it somehow part of common fantasy lore?

There is a Fantasy RPG board on TMP. Given that a lot of old-school RP gamers have switched to Pathfinder or one of various retroclones, maybe the more inclusive label is appropriate.
