I am not ready to name names but I just want to say that I have commissioned quite a lot of 6mm 7yw that are not going to be finished. They were supposed to be done by last fall and then things happened… It was really somewhat predictable but I decided to be trusting, silly me. The last I heard was of a pipe freezing and breaking causing massive damage but that was last December with no communication since. So, I have sent one further email simply asking for my stuff back and an email to confirm and I'm waiting. Hopefully, he will get back to me before the "name and shame" happens.

Really, what would he do with the minis? If he's a bit tight I can understand but this is my stuff not his. He must return my property if the contract is broken.

Hi,
I am not sure on US trade law.. But if you ordered it and he has started to paint them you have to pay him. You can demand a discount because of the delay… the contract is therefore not broken only insufficently executed. Have you a contract with him in written form with a stict deadline and a penalty clause?

I am courious how it turns out… Please keep us posted…

Baddaski, keep in mind that a painting service is basically an artistic subject not a simple shop. For example we satisfy all of our customers, I hopeevil grin, but we are not a "super fast" painting service. We advice the customer of the painting progress but the fate always lies in wait…wink

You ordered from this painting service since you like the painting style, I think, so all I can say to you is be patientgrin

Yes, I took all of that into account.

There was no written contract because I feel that to be a little rude amongst war gamers. I was prepared to simply take the loss and grouse about it.

I've actually been waiting something like 4 months past the agreed dead line (and that time frame was a bit tenuous) and been pretty patient but when communication seems to simply stop (last December) it sends a message. Anyway, I have received an email that my minis are on the way back. No idea if they are painted but we will see.

I can sympathize with your problem. This has happened to me on more than one occassion. The painter suffers burnout or personal difficulties and rather than just owning up to the problem and returning the figures, they go off the radar. Most recently I purchased a painted 1/100 scale Blackhawk off ebay from a chap who had done some commission work for me in the past. In addition to the eBay purchase, I commissioned and paid for 7 more choppers, some more Blackhawks, a couple of Apaches and a couple of Little Birds. A year has passed. No choppers and all communication as ceased as my emails remain unanswered. I appreciate that "real life" can often interfere with the best of intentions. I really don't care about the money sent, but I did want the choppers, which are difficult to find in that scale and I have advised him that all I want at this stage are the choppers, in whatever state they are in but still, no response. Like the OP, I have always been reluctant to name names etc.

Again, like the OP, I have always taken the position that those in the hobby are gentlemen/women and am always surprised when their actions turn them into thieves. I guess they must figure that it is not worth the client's time or money to get law enforcement involved or to initiate legal action.

Glad to hear you are getting your figures back. I have lost all hope of ever seeing the choppers ordered. Fortunately, I was able to re-acquire the Blackhawks and the Apaches in the proper scale but I've had to compromise on the Little Birds.

Alcibiades, could you post the email address of your painter. I am looking for 1/100 Blackhawks and it sounds like I might be able to pick them up cheap from him!
