Just to keep everyone up to date.

We have run up our colours, fired a warning shot across eBay's bow and raked the pirate with a broadside.

The culprit, who has the eBay username pj.brado69, has admitted (via email) to selling our items and that he knew they were TimeCast copies. He claimed to have bought the models "at a market" in his town. However we believe that the person concerned purchased a set of the models from us in December, made moulds from them and started selling the items on eBay in January. We have good evidence to back this up and have passed the details to UK Trading Standards, who have accepted our information.

We have filed a VeRO IP Infringement notice with eBay and are talking to them.

The same eBay user, pj.brado69, has also been selling unauthorised copies of 1/12th scale Doll's House accessories. We have informed the company concerned and they have also filed a VeRO IP Infringement notice with eBay. This information has also been passed to Trading Standards.

The Ebay user's account is currently empty with no items for sale – so far so good.

Incidentally, we have learned quite a bit about how to handle cases like this over the past couple of weeks, and have been given some very good advice from the local trading standards chap, who has been very helpful. To save time should this happen again I will be drawing up a "to do" list of procedures to follow (based on advice from Trading Standards). If any UK manufacturers find themselves in a similar position we will be happy to talk to them and give them any advice we can based on our own experience.

Following advice from Trading Standards we have come up with a plan which allows us to build a complete case against a pirate without him knowing he is being watched. There are also a few methods of tracking the individual without their knowledge.

We don't want to alert someone that we are on their case until we present them with a cease and desist notice on the same day that we hit eBay with a formal complaint about the seller.

You do not tell the enemy what your plans are before the battle starts…

Unless he reads TMP, of course. You might want to ask Bill to remove this thread (and update us all on it after the fact) if you want to keep it a little bit more low key.

I don'y think the person concerned is a gamer – he probably won't read TMP.

He already knows he has been reported, but he doesn't know much more than that.

We still have a couple of tricks up our sleeve – the nice trading standards chap has said I can play with the culprit for a while…
